- Payment & Billing
- Payment Information: The Client agrees to provide valid credit/debit card or checking account information (“Payment Information”) to facilitate the booking and payment of services. All payments will be processed according to the terms specified below.
- Auto-Billing: By purchasing a 4-week package, the Client authorizes the Studio to automatically bill the Payment Information on file every 4 weeks, starting from the date of purchase. These charges will continue until the Client cancels the plan through their Healthie client portal or notifies the Studio in writing. Clients may now stop future automatic payments for recurring package subscriptions directly through their Healthie portal in accordance with FTC regulations. Cancellations will take effect at the end of the current billing cycle.
- Pricing: The pricing for all packages is subject to change at any time. However, the Client will be notified in advance prior to any changes in charges to their account.
- Refund Policy: Refunds are only applicable if the Client cancels their subscription or service before using any sessions within the current billing cycle. Once any session has been used, no refund will be issued for that billing cycle.
- Cancellation of Service: If the Client cancels their monthly package after using any sessions, the automatic billing will stop, but the sessions will remain valid until the end of the current 4-week period.
- Package Upgrades & Downgrades
- Upgrades: If the Client wishes to upgrade their package, the new package will take effect at the start of the next 4-week billing cycle. Mid-cycle upgrades are not available. Clients who require additional support before their new package begins may purchase à la carte sessions separately.
- Downgrades: If the Client chooses to downgrade their package, the new package will take effect at the start of the next 4-week billing cycle. Mid-cycle downgrades are not permitted.
- Package Structure: Packages are structured on a recurring 4-week billing cycle, starting from the date of purchase. Unused sessions will not roll over to the next cycle.
- Missed Appointments & Cancellations
- 24-Hour Cancellation Policy: If the Client fails to attend a scheduled session or cancels with less than 24 hours’ notice, the session will be considered “used” for the current 4-week cycle. The Client agrees to pay the à la carte price for any session they wish to reschedule after a late cancellation.
- Late Arrivals: If the Client arrives late to a scheduled session, the missed time will be considered part of the session, and the session may be shortened accordingly. If the Client arrives more than 15 minutes late, the session will be treated as a no-show and counted as “used” for the cycle.
- No-Show Policy: If the Client fails to attend a scheduled session without prior notice, the session will be forfeited, and no refund or credit will be provided. The Client agrees to pay the à la carte price for any session they wish to reschedule after a no-show.
- À La Carte Services
- Prepayment: All à la carte services must be prepaid at the time of booking.
- Refunds for À la carte Services:
- If the Client cancels with more than 24 hours’ notice, a full refund will be issued.
- If the Client cancels with less than 24 hours’ notice but before the scheduled appointment time, a 50% refund will be issued.
- If the Client cancels at the scheduled appointment time or after, it will be considered a no-show, and a refund will not be issued.
- No refunds will be issued for no-showed appointments.
- Gold Package Kickoff Session
- The initial 90-minute kickoff session is priced at $150 and will be charged separately at the time of booking. If you decide to purchase the Gold Package, the cost of the kickoff session will be deducted from the price of the first billing cycle. The first billing cycle of the Gold Package will be $195, with the regular price of $345 applied to subsequent billing cycles every 4 weeks.
- If the Gold Package is not purchased after the kickoff session, the full price of the kickoff session ($150) will remain due.
- Extended Coach Absences
- If the Studio is unavailable for an extended period of time (defined as 8 or more consecutive days), all active coaching packages will be temporarily paused. This includes the suspension of billing and access to services such as coaching sessions and between-session support.
- Upon the Studio’s return, packages will be resumed, and billing will restart on the new date of reactivation. This may result in a shift in the Client’s original billing schedule.
- Clients will be notified in advance of any planned extended absences and informed of the pause and resume dates. In the event of an unplanned emergency or unexpected time off, communication will be provided as soon as reasonably possible.
- This policy applies to all recurring coaching packages. À la carte services are unaffected unless rescheduling is required.
- Note: Nyxology Studio LLC reserves the sole right to determine when an absence qualifies as an extended period and when package pauses are warranted.
- Miscellaneous
- Policy Exceptions: The Studio reserves the right to make exceptions to these policies at its sole discretion, based on individual circumstances. Exceptions may be made, but are not guaranteed, and must be confirmed in writing by the Studio.
- FTC Compliance: These terms reflect compliance with the Federal Trade Commission’s “Click to Cancel” rule, which ensures clients have the ability to stop future automatic payments through their Healthie client portal with minimal friction.
- Client Responsibility: By booking services with Nyxology Studio LLC, the Client acknowledges that they have read and understood all policies, including payment, attendance, and refund terms, and agree to be bound by them.
- Agreement to Terms
- The Client acknowledges and agrees to the terms and conditions outlined above regarding attendance, cancellation, pricing, and refund policies. The Client understands that failure to adhere to these policies may result in forfeiting payments or services, and that the Studio is not liable for any inconveniences caused by missed sessions or late cancellations. The Client further agrees to make payment for services in accordance with the pricing structure and billing schedule outlined above and understands that they may contact the Studio directly for any clarifications or to discuss specific concerns regarding billing, cancellations, or services.
